Legal Protection by PT Jasa Raharja Against Foreign Tourists who Have Traffic Accidents in Denpasar

Social insurance plays a vital role in maintaining public welfare and stability by providing protection against accident risks. PT Jasa Raharja is mandated to manage passenger accident insurance and third-party liability insurance under Law No. 33 of 1964 and Law No. 34 of 1964, including for foreign tourists. This study aims to analyze the legal protection provided to foreign tourists involved in traffic accidents in Denpasar and identify the obstacles PT Jasa Raharja faces in processing compensation. Using an empirical legal research method, this study applies statutory, conceptual, sociological, and legal-sociological approaches. Data were collected through interviews and observations, supported by primary and secondary legal materials. The research was conducted in Denpasar through PT Jasa Raharja Bali. The findings reveal that PT Jasa Raharja has implemented legal protection in accordance with prevailing regulations, including compensation payments to foreign tourists. From 2020 to 2024, a total of Rp 361,858,728 was disbursed for 26 recorded cases in Denpasar. Compensation amounts follow PMK No. 15/2017 and PMK No. 16/2017, covering death, injury, and burial costs for victims without heirs. Key obstacles include coordination challenges with embassies and consulates, regulatory differences between countries, and technical issues in fund transfers. In response, PT Jasa Raharja has strengthened inter-agency coordination, promoted regulatory harmonization, and optimized international payment mechanisms. This study highlights the importance of institutional synergy in enhancing legal protection and ensuring timely compensation for foreign tourists in Indonesia.
